Terms of use
Terms for using the Westheath Infrastructure Advisory website, with separate engagement terms for professional services and company information.
Website terms
These terms apply to your use of this website. Please read them before using the site. If you do not accept them, please do not use the site.
1. Who operates this site
This website is operated by WESTHEATH MANAGEMENT CONSULTANCIES LIMITED, company number 15808364, registered in England and Wales. Westheath Infrastructure Advisory is the trading identity under which the Westheath companies provide infrastructure advisory services. Full details of those companies are on our Company information page.
In these terms, "we", "us" and "our" mean the operator named above.
2. What this website is for
This website is published for general information about our practice, our services and our experience. It is not advice, and it is not a substitute for advice. Nothing on this site is intended to be relied on in making, or refraining from making, any decision.
3. No adviser relationship, and no offer
Using this website does not create a professional adviser and client relationship between you and us. Nor does sending us an enquiry, by email or otherwise — an enquiry is an enquiry, and we may decline it or be unable to accept it.
Nothing on this website is an offer, a quotation, or a commitment to provide any service on any terms. Descriptions of our services, our experience and our approach are illustrative of work we do; they are not a warranty that we will provide any particular service, in any particular way, to any particular timescale, or at all.
4. Professional services are provided under separate terms
We provide professional services only under separately agreed appointment or engagement terms recorded in writing between us and our client. Those terms — and not these website terms — govern the services, the scope, the fees, the responsibilities of each party, the liability that attaches to the work, and the law and jurisdiction that apply to the appointment. Nothing on this website varies, supplements or is incorporated into any appointment.
5. Accuracy and currency
We take reasonable care to ensure that the information on this website is accurate and up to date when published. We do not warrant that it is complete, accurate, or current, and we are under no obligation to update it. Descriptions of past work are summaries; they omit detail, they are subject to the confidentiality obligations we owe our clients, and they should not be read as a full account of any engagement.
6. Reliance
You should not rely on anything on this website. If you want advice on a matter, ask us — or another suitably qualified adviser — and take advice on the facts of your situation.
7. Our liability
Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any other liability that cannot lawfully be limited or excluded.
Subject to that, and to the extent permitted by law, we are not liable for any loss or damage — whether in contract, tort (including negligence), breach of statutory duty or otherwise — arising out of or in connection with your use of this website, your inability to use it, or your reliance on anything published on it. This includes loss of profit, loss of business, loss of contracts, loss of anticipated savings, loss of data, and any indirect or consequential loss.
This clause is about this website. It has nothing to do with the liability that attaches to our professional work, which is dealt with in the appointment terms for that work.
If you are dealing with us as a consumer, this clause does not affect your statutory rights.
8. Intellectual property
The content of this website — including text, layout, graphics, diagrams and the Westheath name and marks — is owned by or licensed to us and is protected by intellectual property law. You may view it, and print or download extracts, for your own information or for use within your organisation. You may not otherwise copy, reproduce, republish, distribute or commercially exploit any part of it without our written permission.
9. Links to other sites
Where this website links to a site we do not control, the link is provided for convenience. We do not endorse the linked site and we are not responsible for its content, its availability or its handling of your information.
10. Availability of this website
We do not guarantee that this website will be available, uninterrupted or error-free. We may suspend, withdraw or restrict all or part of it without notice.
11. Changes
We may change the content of this website, and these terms, at any time. The version published here is the version that applies. Please check it when you visit.
12. Governing law
These website terms, and any dispute arising out of or in connection with your use of this website, are governed by the law of England and Wales, and are subject to the non-exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country in which you live, and you may bring proceedings in the courts of that country.
This clause applies to your use of this website and to nothing else. It does not determine the law governing any appointment or engagement with any Westheath company — that is agreed separately, appointment by appointment, and may be a different law and a different jurisdiction. It does not determine which data protection law applies to your personal data; that is set out in our Privacy notice.
